The short answer to this question is that “no-fault” does not apply to accidents involving motorcycles in New York State. “No-fault” insurance applies to car, truck and bus accidents rather than accidents involving motorcycles. Under Article 51 of the New York State Insurance Law motorcyclists and their passengers are excluded from coverage. Because motorcycles are not considered to be motor vehicles under Section 5102(f) of the law, they are not covered by no-fault insurance.
